Texas SB1315 allows counties and municipalities to prohibit cigarette, e-cigarette, and tobacco product sales near specific locations.
Texas SB1315 amends the Health and Safety Code to allow county and municipal authorities to prohibit the sale of cigarettes, e-cigarettes, and tobacco products within 300 feet of a church, public hospital, or public or private primary or secondary school campus. It also allows prohibitions within 1,000 feet of a public or private primary or secondary school campus upon request from the school district board of trustees or the governing body of a private school. These prohibitions do not apply to establishments where less than 50% of gross receipts come from tobacco product sales.
