SB11

Relating to an affirmative defense to prosecution for certain victims of trafficking of persons or compelling prostitution.

Complete·9/17/25

Texas SB11 provides an affirmative defense for victims of trafficking or compelling prostitution.

Texas SB11 amends the Penal Code to establish an affirmative defense for individuals prosecuted for offenses committed as a result of being trafficked or compelled into prostitution. This defense applies if the individual was a victim of trafficking or compelling prostitution and engaged in the conduct due to force, fraud, or coercion. The defense is not available if the individual was merely given an opportunity to engage in the conduct without coercion, or if the conduct constitutes an offense listed in Article 42A.054(a), Code of Criminal Procedure, unless charged only as a party to that.
