Texas SB1082 amends the Insurance Code to add a new subchapter addressing the declination and nonrenewal of residential property and personal automobile insurance policies based on previous claims. Insurers are prohibited from using the fact that an applicant or policyholder previously made an insurance claim or the amount of a previous claim as a basis for declining or nonrenewing a policy. However, insurers may still consider the circumstances under which a previous claim was made. The changes apply to policies delivered, issued for delivery, or renewed on or after January 1, 2026.
