Texas HB917 amends Article 2A.105(b) of the Code of Criminal Procedure to prohibit district or county attorneys from acting as counsel against the state in any case, except as an attorney ad litem under Chapter 262 of the Family Code. Additionally, it prohibits these attorneys from representing opposing counsel in any case they were previously involved in after they leave office. The changes apply only to offenses committed after the Act's effective date of September 1, 2025. Offenses committed before this date remain governed by the law in effect at the time of the offense.
