Texas HB802 modifies the process for approving beach access and use plans by local governments. Local governments must submit these plans to the commissioner for certification. The commissioner must act on the plans within 90 days, either approving, partially approving, or denying them. If denied or partially approved, the commissioner sends the plan back with objections and suggested modifications. Local governments can then revise and resubmit the plans. The commissioner's certification is adopted into rules under Section 61.011.
