Texas HB5604 regulates access by certificated providers to electric cooperative rights-of-way and poles.
Texas HB5604 amends the Utilities Code to establish rules for certificated providers accessing electric cooperative rights-of-way and poles. An electric cooperative must provide nondiscriminatory access to certificated providers for facility placement, pole attachment rates, and building access. The cooperative cannot charge rates exceeding those agreed upon in contracts or those set by the Public Utility Commission of Texas. Additionally, the cooperative cannot charge for evaluating pole viability or load if these costs exceed established fees.
