Texas HB5325 amends the Local Government Code to require that plats for land subdivisions in priority groundwater management areas include a certification from a licensed engineer or geoscientist that adequate groundwater is available. The Texas Commission on Environmental Quality will establish rules for the form and content of this certification and define credible evidence of groundwater availability. Commissioners courts may adopt water availability requirements if necessary to prevent water use from exceeding sustainable yield. The Act takes effect January 1, 2026.
