Texas HB5164 amends the Labor Code to create a new chapter on paid parental leave. Employers with 50 or more employees must provide 60 days of paid leave to eligible employees for the birth of a child, birth of a child by a spouse, birth of a child by a gestational surrogate, adoption of a child, or provision of foster care or kinship care to a child under one year old. Leave can be taken before the birth of the child in some cases. Employees cannot take leave more than once in a 12-month period and must take leave within the first year of the child's birth or adoption.
