HB5046 amends the Business & Commerce Code to require controllers to disclose when they sell personal data to third parties or use it for targeted advertising. Controllers must also inform consumers how to opt out of such practices. Additionally, if a controller sells a consumer's personal data to a third party, they must pay the consumer 10 percent of the gross proceeds within 60 days of the sale. This Act takes effect September 1, 2025.
