Texas HB5011 amends the Property Code to allow property owners to withhold assessment payments if they bring an action against their property owners' association. If the association prevails, the owner must pay the withheld assessments and resume payments. The association cannot sue a prevailing owner to collect withheld assessments. These provisions apply only to actions filed after the Act's effective date of September 1, 2025. Prevailing associations can recover court costs and attorney's fees.
