Texas HB4933 amends Article 18.19(c) of the Code of Criminal Procedure to set forth procedures for the disposition of seized weapons when the possessor is not prosecuted or convicted. If no prosecution or conviction occurs, the magistrate must notify the possessor within 60 days that they can reclaim the weapon upon request. The possessor has 60 days to request the weapon, after which the magistrate must return it. If the weapon is not reclaimed within 61 days of notification, the magistrate must order its destruction, sale, or forfeiture.
