Texas HB4829 amends the Code of Criminal Procedure to redefine "gender" and "sexual preference" for bias-motivated offenses.
Texas HB4829 amends Article 42.014(c) of the Code of Criminal Procedure to redefine "gender" as the actual or perceived gender-related characteristics of an individual, regardless of their designated sex at birth. It also limits the definition of "sexual preference" to heterosexuality, homosexuality, or bisexuality. The changes apply only to offenses committed on or after the effective date of the Act, which is September 1, 2025. Offenses committed before this date remain governed by the previous law.
