Texas HB4272 allows municipalities to require relocation of certain facilities at the utility's expense for street widening or municipal projects.
Texas HB4272 amends the Utilities Code to allow municipalities to require certificated telecommunications utilities and holders of a state-issued certificate of franchise authority to relocate their facilities in municipal public right-of-ways. The relocation must be at the municipality's expense from collected right-of-way fees, for purposes such as street widening or straightening, or to accommodate another municipal project. The municipality must provide at least 30 days' notice and specify the new location for the facility along the right-of-way. This Act takes effect September 1, 2025.
