Texas HB413 would prevent defendants from being detained in jail longer than their potential punishment.

Texas HB413 amends the Code of Criminal Procedure to add Article 17.1511, which mandates that a defendant charged with an offense punishable as a Class B misdemeanor or higher cannot be detained in jail pending trial for a period that exceeds the maximum term of confinement for that offense. This provision does not apply to defendants being evaluated for competency or those subject to a commitment order under Chapter 46B. The changes apply only to individuals arrested on or after the effective date of the Act, which is September 1, 2025.
