Texas HB3726 amends Section 545.157(a) of the Transportation Code to specify the types of vehicles that are exempt from the offense of passing. These include stationary authorized emergency vehicles, stationary tow trucks, Texas Department of Transportation vehicles, highway maintenance or construction vehicles, service vehicles used by utilities, vehicles transporting municipal solid waste or recyclable material, vehicles operated by toll project entities, and vehicles stopped on the shoulder or adjacent to the highway using hazard lamps. The changes take effect September 1, 2025.
