Texas HB3449 amends Article 26.05 of the Code of Criminal Procedure to change how expenses are reimbursed to counsel in noncapital cases. These counsel, excluding those from public defender's offices, will be reimbursed for reasonable and necessary expenses, including investigation costs, mental health and other expert fees, and travel-related expenses if the defendant is held more than 50 miles from the court. Expenses incurred with prior court approval will follow the reimbursement process for capital cases, while those without approval will follow a different process.
