Texas HB3441 amends the Health and Safety Code to add a new section on the liability of vaccine manufacturers. A manufacturer becomes liable to an individual if they advertise a vaccine in Texas and the vaccine causes harm or injury to the individual. A court may award a prevailing claimant actual damages, court costs, and reasonable attorney's fees. This change in law applies only to causes of action that accrue on or after the effective date of the Act, which is September 1, 2025.
