Texas HB3206 amends Article 35.23 of the Code of Criminal Procedure to allow courts to sequester juries in criminal cases. The court may permit jurors to separate until the court has given its charge to the jury. After the charge, the court may order that the jury not be allowed to separate if good cause is found. A motion to sequester the jury must be filed at least 10 days before jury selection begins. If jurors are kept overnight, separate facilities must be provided for female jurors. In misdemeanor cases, the court may permit the jurors to separate at any time before the verdict.
