Texas HB3106 amends the Water Code to allow regional water planning groups to evaluate water availability based on a reservoir's safe yield. This analysis considers the reduced annual water volume that would remain available during a drought longer than a drought of record. If a planning group chooses not to use this analysis, they must explain their decision in the regional water plan. The changes take effect September 1, 2025.
