Texas HB308 creates a criminal offense for trespassing on or near school or day-care center property.

Texas HB308 amends the Penal Code to establish a new criminal offense for trespassing on or near school or day-care center property. A person commits an offense if they enter or remain on school or day-care center property or public property within 250 feet of such property without written permission and fail to leave after a reasonable request from an authorized representative. The offense is classified as a Class A misdemeanor. The act takes effect on December 1, 2025.
