Texas HB3016 amends the Business & Commerce Code to limit the circumstances under which a rental company can void a damage waiver. A rental company may not void a damage waiver unless the damage was caused by an authorized driver acting intentionally or with wanton misconduct, or if the vehicle was used by an unauthorized driver, under the influence of an intoxicant, for hire, for training, to push or tow, in a speed contest, or outside the continental U.S. without authorization.
