Requires the charging instrument in resisting arrest cases to state the underlying offense.
Texas HB2934 amends the Code of Criminal Procedure to mandate that the complaint, information, or indictment in a resisting arrest case must specify the underlying offense for which the arrest was made. This change applies only to cases where the complaint, information, or indictment is presented to the court after the Act's effective date of September 1, 2025. Cases presented before this date remain governed by existing law.
