The principal or other appropriate administrator must suspend the student if the conduct occurs on or off school property and either constitutes an offense under the Penal Code or is deliberately violent and threatens the health or safety of another. The suspension requirement does not apply to students with disabilities whose conduct would constitute a change in placement under federal law.
