Texas HB2909 amends the Property Code to allow courts to expunge records related to residential eviction suits. A court may order records expunged if the suit was without sufficient basis in fact or law, or if the tenant has maintained gainful employment for at least two years after a final judgment. Expunged records cannot be considered by landlords in rental applications. The Texas Supreme Court must adopt rules to implement these changes by January 1, 2026. The act takes effect September 1, 2025.
