Texas HB2459 amends Section 51.014 of the Civil Practice and Remedies Code to alter the stay of proceedings in the trial court when an interlocutory appeal is filed after a denial of a motion to dismiss. Specifically, it changes the conditions under which a trial and other proceedings can be stayed. The changes apply only to denials of motions to dismiss ordered after the effective date of the Act. The Act can take effect immediately if it receives a two-thirds vote in both houses of the Texas Legislature, otherwise it takes effect September 1, 2025.
