This bill allows a person injured by a crime committed by someone unlawfully present in the United States, or the representative of someone killed in such a crime, to bring a civil action against local entities and campus police departments. To prevail, the plaintiff must prove the existence of a policy in violation of certain laws and a failure by the local entity or campus police department that allowed the unlawfully present person access to the victim. The court may award damages, costs, and attorney's fees to the prevailing party. The act takes effect September 1, 2025.
