Texas HB1644 amends Section 481.125 of the Health and Safety Code to exempt individuals from penalties related to the use, possession, delivery, or manufacture of testing equipment that identifies the presence of fentanyl, alpha-methylfentanyl, any other derivative of fentanyl, or xylazine. This change applies only to offenses committed after the effective date of the Act, which is September 1, 2025. Offenses committed before this date remain governed by the law in effect at the time the offense was committed.
