Texas HB1631 limits detention durations for children in juvenile court and mandates a study on detention effects.
Texas HB1631 amends the Family Code to limit the duration of detention orders for children in juvenile court proceedings. A detention order now extends to the conclusion of the disposition hearing, but no more than five working days. Subsequent detention orders are limited to five working days, or seven in counties without a certified juvenile detention facility. The Texas Juvenile Justice Department must conduct a study on the effects of these detention orders, analyzing detention durations and intervals between hearings, and submit a report by December 1, 2026.
