Texas HB1549 amends the Business & Commerce Code to restrict the sale of obscene devices. A business may not sell, offer for sale, or hold for sale an obscene device unless it is a sexually oriented business operating under Chapter 102. County or district attorneys can seek injunctions and civil penalties up to $5,000 per violation. The act takes effect immediately if approved by two-thirds of the legislature, otherwise on September 1, 2025.
