Texas HB1191 amends the Labor Code to regulate how employers can inquire about and consider an applicant's criminal history record information. Employers are prohibited from asking about criminal history on initial employment applications. They may only inquire into or consider such information after determining the applicant is qualified and after conditionally offering employment or inviting the applicant to an interview. This rule does not apply to positions where criminal history consideration is required by law. The changes will take effect on September 1, 2025.
