Texas HB1139 voids venue provisions requiring Texas residents to litigate out of state for real property improvement contracts.
Texas HB1139 amends the Civil Practice and Remedies Code to declare void any venue provision in a contract for real property improvements that requires a Texas resident to litigate outside the state. If such a venue provision is void, the action must be brought in Texas, in the county where the defendant resides, the cause of action accrued, or the property is located. This change applies only to contracts entered into after the Act's effective date of September 1, 2025.
