Texas HB1099 amends the Property Code to establish a landlord's duty to provide and maintain a functioning air conditioning system or unit in an apartment unit. The air conditioning must maintain a temperature of at least 85 degrees Fahrenheit or 10 degrees Fahrenheit below the recorded outdoor temperature, whichever is lower. The landlord's duty cannot be waived and applies to residential leases entered into or renewed on or after the effective date of the Act, which is September 1, 2025.
