SB2576 amends Tennessee Code to enhance protections for pharmacies in their dealings with pharmacy benefits managers. It mandates that pharmacy benefits managers must reimburse pharmacies at least the greater of the actual cost, 105% of the national average drug acquisition cost, or the wholesale acquisition cost. The bill also requires pharmacy benefits managers to pay a professional dispensing fee at least equal to the amount paid by the TennCare program. Pharmacies can appeal reimbursement rates and must be reimbursed within 14 days if they prevail.
