Tennessee SB1138 prohibits certain municipalities and utility districts from ceasing sewer operations outside their boundaries if they have been.

Tennessee SB1138 amends state law to ensure that cities, towns, and utility districts cannot cease operating sewer systems or sewage treatment works outside their corporate or unincorporated boundaries if they have been doing so for 25 years or more. The cessation is prohibited as long as the systems maintain sufficient capacity, as determined by a study from the Tennessee advisory commission on intergovernmental relations (TACIR). This applies to sewerage systems and sewage treatment works operated by cities, towns, and utility districts.
