This bill amends Tennessee law to establish a rebuttable presumption that a person meets the standard for emergency detention and examination if they were charged with an offense and ordered to undergo an evaluation to determine their competency or mental capacity at the time of the crime. This presumption applies to offenses where the defendant would serve at least 85% of their sentence before becoming eligible for release. The presumption can be rebutted only by clear and convincing evidence that the person does not pose an imminent substantial likelihood of serious harm.
