Tennessee HB2386 amends various titles of the Tennessee Code to allow political subdivisions to require developers to fund offsite public infrastructure improvements. If a political subdivision determines that such improvements are necessary for a development project, it may require the developer to construct or pay for these improvements. The cost-sharing arrangement between the developer and the political subdivision must be based on the proportionate utilization or impact the development has on public infrastructure. The political subdivision has 60 days to make this determination.
