HB2269

AN ACT to amend Tennessee Code Annotated, Title 30; Section 56-7-206 and Title 62, Chapter 5, relative to probate.

Introduced·2/2/26
Draft Text

Allows pro se proceedings for small estates with life insurance policies under $15,000 for burial expenses.

This bill amends Tennessee's probate laws to allow individuals to proceed pro se for estates with life insurance policies valued at $15,000 or less, intended for burial or funeral expenses. It clarifies that filers for small estate affidavits or limited letters of authority act in an individual capacity, not as representatives. The court clerk must provide a standardized form for those meeting these criteria. The act takes effect immediately upon becoming law.
