HB2028 protects small businesses from being blacklisted by online search engines and other platforms.

HB2028 amends Tennessee law to protect small businesses from being blacklisted by online search engines and other platforms. A "blacklist" involves reducing visibility, removing search results, or deleting reviews. If a business entity blacklists a small business, the court may order injunctive relief. The business entity must notify the small business within 24 hours, explaining the action and providing information on how to remedy it. If the business entity fails to comply, the small business can sue for actual damages, punitive damages, and reasonable court costs and attorney fees.
