Tennessee HB1861 introduces a new subsection to Title 40, Chapter 35, modifying the conditions for revoking probation and suspension of sentence for felony offenses. If a trial judge finds that a defendant has violated probation by engaging in a drug offense, the judge must order the defendant to attend a substance abuse treatment program instead of revoking probation for the first instance of such a violation. This act will take effect on July 1, 2026.
