Complete·3/30/26

Presumptive denial of personal recognizance bail for defendants charged with firearm offenses or causing serious bodily injury or death.

This bill amends Tennessee law to establish a presumption against releasing defendants on personal recognizance if they are charged with offenses involving firearms or causing serious bodily injury or death. If a magistrate or authorized official determines this presumption has been rebutted, they must include written findings for each factor in the bail order. The terms "firearm" and "serious bodily injury" are defined as in § 39-11-106. The act takes effect July 1, 2025.
