South Dakota SB170 mandates disclosure when consumers interact with chatbots that simulate human conversation.

South Dakota SB170 requires businesses to inform consumers when they are interacting with chatbots or artificial intelligence that mimic human conversation. This notice must be provided at the outset of the interaction to prevent misleading or deceiving the consumer. Consumers or the attorney general can sue for actual damages, liquidated damages, or class action damages, along with attorney's fees and costs. The bill exempts internet service providers from liability if they merely transmit the interaction. The attorney general can also seek injunctive relief against non-compliant parties.
