South Dakota SB163 repeals provisions related to the shared parenting child support cross credit. This bill removes the ability for courts to grant a credit on child support amounts if a detailed shared parenting plan is in place. The bill also removes the ability to grant an abatement of child support if a child resides with the obligor six or more nights in a month. The court must consider the fixed obligations of the custodial parent and the increased costs of the noncustodial parent when deciding whether an abatement is appropriate.
