Restricts processing of personal data of individuals aged 16 or younger online.

South Dakota HB1309 restricts the processing of personal data of individuals aged 16 or younger online. Operators of mobile applications, online applications, online services, or websites must destroy or delete personal data of covered users within 14 days unless processing is permitted. Processing is allowed if the user is under 13 and parental consent is obtained, under 16 and necessary for specific activities, or if the user is under 12 and permitted under federal law. The attorney general can bring civil actions or impose penalties for violations.
