South Dakota HB1103 limits annual groundwater withdrawals to the annual recharge rate of the source.

South Dakota HB1103 amends § 46-6-3.1 to ensure that no application to appropriate groundwater may be approved if the annual withdrawal exceeds the average estimated annual recharge of water to the groundwater source. Exceptions are made for withdrawals from formations older than or stratigraphically lower than the greenhorn formation for use by water distribution systems.
