South Dakota HB1053 mandates that terminal care facilities, including hospitals, inpatient hospices, and residential hospices, permit terminally ill patients to use medical cannabis. The bill defines a terminal condition as a medical condition with a life prognosis of less than one year. Patients must present their registry identification card and have their attending practitioner document the use of medical cannabis in their medical records. Smoking or vaping cannabis is prohibited within the facility.
