South Dakota HB1040 revises the child support obligation schedule. The combined monthly net incomes of both parents must be used in determining the obligation, divided proportionately based on their respective net incomes. The noncustodial parent's proportionate share establishes the amount of the child support order. A noncustodial parent who is incarcerated for more than 180 days is obligated to no less than the minimum base obligation amount. The share of the custodial parent is presumed to be spent directly for the benefit of the child.
