Insurers must consider an enrollee's medical history and unique clinical circumstances, and ensure the software is reviewed for accuracy. The Department of Insurance can intervene if an insurer's use of AI violates the law, including by imposing corrective plans or disciplinary measures. Insurers must also disclose the percentage of denied or modified treatment requests and ensure patient data is not misused.
