S.0821

Lawyer Advertising Unfair Practice

Introduced·1/15/26

Lawyer advertising in South Carolina must now disclose attorney fees, clarify outcomes, and specify lawsuit targets.

This bill amends South Carolina's attorney advertising rules to require disclosures in legal service ads. Ads must show the amount of attorney fees and litigation costs deducted from a settlement. They must also clarify that results are not typical and depend on specific case facts. Ads stating lawsuits are against insurance companies must disclose that lawsuits would actually be against named individuals or businesses, with insurance companies covering only those they insure. Violations are unfair trade practices enforced by the Department of Consumer Affairs.
