South Carolina S0747 amends the state code to establish graduated penalties for individuals convicted of second, third, or subsequent trespassing offenses. A second offense results in a misdemeanor charge, with a fine of up to $750 or imprisonment for up to 60 days. For third or subsequent offenses, the misdemeanor charge carries a fine of up to $1,000 or imprisonment for up to 90 days. These offenses are triable in magistrates court, regardless of other provisions. The act does not affect pending actions or liabilities incurred under previous laws.
