S.0428

Fraudulent Check Expungement

Vetoed·5/19/26

South Carolina S0428 allows for the expungement of arrest records and convictions for multiple misdemeanor check fraud offenses and mistaken identity.

South Carolina S0428 amends the state code to allow for the expungement of arrest records and convictions for multiple misdemeanor check fraud offenses and mistaken identity arrests. The bill adds multiple misdemeanor offenses of check fraud to those eligible for expungement and requires the destruction of arrest records if a person was arrested due to mistaken identity. The South Carolina Law Enforcement Division must keep a nonpublic record of the expunged offense to prevent individuals from taking advantage of the expungement rights more than once.
